The recent rape case in Kolkata has ignited a wave of public outrage, leading to widespread protests and strikes across the city. As citizens demand justice and systemic reform, the question arises: will these protests bring about meaningful change, or will they be another fleeting expression of collective anger? This article explores the situation’s complexities by examining the historical and social contexts of protests in India, particularly in Kolkata, and their potential to effect change in a system rife with gender violence and judicial inertia. Strikes and protests have historically been catalysts for change in India, but their success depends on multiple factors such as political will, sustained media attention, and public perseverance. The article also highlights the evolving role of social media in amplifying and maintaining the momentum of these movements, contrasting it with traditional forms of protest. Additionally, the government’s response and the current legal framework surrounding gender-based violence are critically analyzed to assess whether the public outcry will prompt the necessary reforms or fall into the familiar cycle of outrage followed by inaction. By focusing on the ongoing strikes in Kolkata, this article seeks to provide insights into the potential for societal transformation and the hurdles that lie ahead, questioning the effectiveness of public protests in achieving justice and lasting change in India’s fight against gender violence.

Hospital violence is defying a solution, despite several efforts at the hospital level and at the Government level. Some States do have a specific legislation for prevention of violence against healthcare personnel or damage to hospital property, but these have made little difference. Demand for Central law on this has been under debate for some time but one is not sure if that would also help. The authors in this article have suggested a way forward, if the law on this issue (Central or State) has to bring adequate results.

Medical Defence Unions (MDUs) play a crucial role in providing support to doctors facing such allegations. In the evolving medical landscape, allopathic doctors in India increasingly face the daunting challenge of malpractice allegations. The Medical Defence Union (MDU), a non-profit organization originating in the United Kingdom, has a long-standing history of providing medicolegal assistance to healthcare professionals. This research article explores the potential application of the MDU’s model to the Indian context, focusing on the type of support it provides and its impact on doctors’ professional lives. The paper discusses the similarities and differences between the medico-legal climates of the UK and India, the significance of professional indemnity, and the psychological impact of malpractice claims on doctors. The findings suggest that a structure similar to the MDU in India could offer substantial support to Indian allopathic doctors, mitigating the legal and emotional challenges associated with malpractice allegations. It examines the medicolegal assistance provided by MDUs to Indian allopathic doctors, highlighting the benefits, challenges, and future directions. Through a comprehensive review of existing literature, case studies, and expert opinions, this article provides an in-depth analysis of the role of MDUs in supporting doctors in medicolegal issues.

India is a populous nation with a wide range of socio-economic circumstances and a diversified population. Because of this variation, it is difficult to establish consistent criteria that address each child’s unique requirements and circumstances. There’s a chance that Indian customs and culture would clash with international norms pertaining to children’s rights. For instance, there are still many areas of the nation where child marriage is common, which violates children’s rights to education and safety from danger. Without regard to social or economic status, everyone has the fundamental human right to an education. This fundamental right, which has significant effects on the development and well-being of tribal children in the future, is sadly denied to a great number of them globally. The difficulties tribal children have in getting a good education will be discussed in this essay, along with the significance of resolving these problems in order to promote the total development of the children. The Constitution of India have the provisions for providing the education to all the children irrespective of their caste, race, sex and place of birth. Why are the tribal children not receiving high-quality education, despite the availability of numerous resources and other facilities? In India, tribal education is a crucial field that requires care and strategic approaches due to their diverse practice of customs and other things. The Education Policies, Teaching Method etc should keep in mind while framing any ruled or regulation for them in respect of education. The issue of medical negligence, particularly the distinction between civil and criminal liability, has been a source of confusion in Indian jurisprudence. The absence of a clear legal definition of medical negligence, combined with varying judicial interpretations, has complicated the adjudication of such cases. This paper examines the judicial framework surrounding medical negligence in India, focusing on landmark judgments like Jacob Mathew and Martin D’Souza. It explores the dilemma posed by the overlapping principles applied to both civil and criminal cases of medical negligence, addressing the confusion stemming from the interpretation of liability. The paper argues that there is no intrinsic distinction between civil and criminal medical negligence, as liability—whether civil or criminal—arises only after the negligence is proven. It also emphasizes the need for judicial clarity and consistency in applying legal standards to medical negligence cases.
